Overview
Under our American system of justice, all persons are presumed to be innocent until proven guilty.
Plea of Guilty
When you enter a plea of guilty:
- You admit that the law prohibits the act that is charged.
- You admit that you committed the act that is charged.
- You will be required to pay the fine.
Plea of Nolo Contendere (No Contest)
When you enter a plea of nolo contendere or no contest:
- You state that you do not contest the state’s charge against you.
- You will almost certainly be found guilty.
- A plea of nolo contendere may not be used against you in any subsequent civil suit for damages.
- You will be required to pay the fine.
Plea of Not Guilty
When you enter a plea of not guilty:
- You deny any guilt.
- A trial (by Judge or jury) will be held with you as the defendant.
- The state must prove the charge that is filed against you.
